Terms & Conditions

Please note - these Terms & Conditions do not supersede your statutory rights under the Sale of Goods acts: they are merely designed to clarify the principles and procedures by which we operate. In any event, we aim to serve our customers fairly and squarely and - should a dispute arise - we will always seek to find a speedy and amicable solution to the problem.

Currency: All transactions are conducted in Pounds Sterling. If in doubt about the conversion rate to currencies other than Sterling, or those featured on the website, please e-mail us with the details of your order and we will calculate the accurate price in your own currency before accepting the order. Payments via this website will be processed in pounds sterling (credit cards sales will be charged in your local billing currency by your credit card provider). If you send a cheque or money order, it must be in £ Sterling.

Tariffs, Taxes & VAT

All £ Sterling prices on the TUSTING website are quoted inclusive of local taxes (including VAT) where applicable.

For countries inside the EC, prices are quoted inclusive of taxes (including VAT) and tariffs. If a valid EU VAT Registration number is provided at the time of ordering, goods will be shipped to non-UK residents of the EU net of VAT.

For the USA , prices are quoted inclusive of all taxes and duty.

For all other countries, purchasers are responsible for duties and/or taxes levied at the point of entry into the destination country.  A commercial invoice is provided with all goods shipped.

Shipping Methods

Orders are sent to you via a secure designated carrier like Fed-Ex, UPS, etc and will require a signature on delivery. Orders sent within the UK should arrive with seven working days from receipt of order. We will always try to dispatch your goods within 48 hours of receipt of order, assuming we have the item/s in stock. Delivery to UK addresses is usually the next day and overseas addresses between 2 to 5 days later. Please allow more time for delivery at busy periods like Christmas.

Carriage Costs

The delivery charges quoted on the website cover delivery via a secure designated carrier like Fed-Ex, UPS, etc. Please contact us if you require special delivery services, prices for which will be quoted upon request.

Payments

Our preferred way of taking payment is Credit or Debit Card Transaction via our Secure Server, where your card details are encrypted before being sent to us, fully protecting any confidential information from prying eyes. You can also send a Cheque, Postal Order or Money Order separately to us. Please note that Card transactions are processed when goods are dispatched, Cheque and Money Order will be cleared before goods are dispatched. All Cheques or Money Orders must be drawn in £ Sterling.

Invoices & Receipts

We send a receipt for all orders, either with the goods or to follow in the post, except those sent to third parties as Gifts. In these cases we send a separate receipt direct to the purchaser.

Returns Policy

TUSTING operates a full, no-quibble 14-day Returns Policy. If you don't like what you've bought, simply return it to us within 14 days of receipt, unused and post-paid, together with the receipt we sent you and details of your reason for return. We will refund the full value of the goods, using the same method as the original payment (i.e. a credit card purchase will be refunded through your credit card account). Please note that the cost of the shipping cannot be refunded.

Damaged Goods

Unfortunately, we are not responsible for damage which occurs after the goods have been handed to the postal or courier service.  However, should you be unfortunate enough to receive damaged goods, let us know immediately. Please retain all relevant documentation so that we can make an insurance claim against the carrier's insurers.  If the parcel you receive is battered, please note the fact when you sign for it, even before you open the package to examine the contents.  If you are unable to open the damaged package in the presence of the carrier, make sure that you sign for it as "Damaged package; goods not yet inspected" to warn the carrier that a claim may follow.

Title to the Goods

Title for goods belongs to TUSTING until your full payment is cleared, at which point it transfers to you in its entirety.

Unavailable Goods

In the event that we cannot ship your whole order within 72 hours of receipt, we will usually dispatch a part order and notify you with regard to items delayed through lack of stock. In the unlikely event that we are unable to supply your choice of goods for some while, or at all, we will contact you for instructions. Providing a telephone number or e-mail address with your order makes it easier for us to contact you in this event.

Please note that Card transactions are only processed when goods are dispatched, Cheque and Money Order will be cleared before goods are dispatched.

Applicable Law and Courts of Jurisdiction

All transactions undertaken through this website are governed by English Law and any legal actions arising out of such transactions shall be subject to the English legal processes and under the jurisdiction of English Courts. In the event of disagreement between TUSTING and its clients, which cannot be mutually resolved in a reasonable time period, customers are invited to participate in a mediation process to settle the dispute. However, this is not compulsory and does not affect the consumer's rights to bring legal proceedings against TUSTING. If the mediation process is agreed, then either party may ask the Institute of Directors (UK) to appoint a mediator to settle any dispute before bringing the matter into the legal process.  In this event, both parties agree to be bound by the decisions of such mediator and mediation process.
